Article 2 - Applicability and amendment
2.1 These general terms and conditions apply to all legal relationships between Cadence and the Participant, to every Participant Agreement and to every visit to the Studio.
2.2 By purchasing a Credit, a Subscription or a Gift Voucher, or by taking part in a Ride or entering the Studio, the Participant declares agreement with these terms and conditions.
2.3 The rights arising from the Participant Agreement are strictly personal and - except as provided in article 5.8 - non-transferable.
2.4 Cadence may unilaterally amend the general terms and conditions. The most recent version is always available on the Website and applies from the effective date stated on the Website. In the event of significant changes, the Participant will be informed by email. If a Participant who has taken out a subscription with Cadence does not agree with the change, the Participant may cancel the subscription via the official cancellation procedure (article 9).
2.5 Deviations from the general terms and conditions are only valid if confirmed in writing by Cadence.
2.6 The provisions in these terms and conditions are also stipulated for the benefit of directors, instructors, employees and other persons working for or on behalf of Cadence.
Article 3 - House rules
3.1 The Participant is required to wear sportswear suitable for indoor cycling, as well as socks.
3.2 Wearing clip-in cycling shoes (SPD system) is mandatory during every Ride. Cadence provides loan shoes free of charge. Street shoes or outdoor sports shoes are not permitted in the spinbox.
3.3 Using a towel during a Ride is mandatory. The Participant may bring their own towel or borrow one (1) free of charge.
3.4 The entire Studio is smoke-free. The use of e-cigarettes and similar products is likewise not permitted.
3.5 Consuming food or drinks brought from outside in the Studio is not permitted, with the exception of water. For refreshments, Cadence refers Participants to its Bar.
3.6 The spinbox door closes at the start time of the Ride. Participants who arrive more than five (5) minutes after the start may be refused entry for safety reasons, without the right to a refund of the Credit.
3.7 Cadence reserves the right to refuse Participants access to the Studio or to ask them to leave the Studio in the event of nuisance, alcohol or drug use, inappropriate behaviour towards employees or other Participants, or misuse of the facilities.
3.8 Cadence is entitled to close the Studio wholly or partly on recognised public holidays, during renovation or maintenance, or in other special circumstances.
3.9 Cadence does not allow dogs in the Studio.
3.10 The Participant must promptly and on their own initiative report changes to address details, email address, telephone number and payment details via the account on the Website or the app.
Article 4 - Booking and participation in Rides
4.1 Participation in a Ride requires advance reservation via the booking system on the Website or in the Cadence app. Without a confirmed reservation, the Participant has no right to participate.
4.2 The Participant may cancel free of charge up to twelve (12) hours before the start of a Ride via the booking system. In the event of later cancellation or failure to show up (no-show), one (1) Credit will be deducted, even if the Ride is part of a Subscription.
4.3 In the event of a waiting-list spot, the Participant will receive a message as soon as a spot becomes available, at the latest thirty (30) minutes before the start. If the Participant has moved up from the waiting list and does not show up, this counts as a no-show and one (1) Credit will be deducted.
4.4 Cadence is entitled to change the class schedule, the number of Rides per day and the instructor from time to time. Announcements will be made via the Website and/or the app.
4.5 Cadence may cancel a Ride due to insufficient bookings, illness of the instructor or other business reasons. In that case, the deducted Credit will be credited back to the Participant's account. The Participant is not entitled to any further compensation.
4.6 If, within a consecutive period of two (2) weeks, a Participant cancels late or fails to show up two (2) or more times, Cadence may suspend the booking right for a maximum of two (2) weeks.
4.7 The minimum age for independent participation in a Ride is sixteen (16) years.
Article 5 - Subscriptions and credits
5.1 A Subscription is entered into for the minimum term stated on the Website. After that, the Subscription is automatically renewed for an indefinite period, unless cancelled in accordance with article 9.
5.2 The number of Rides per term included in a Subscription is stated on the Website. Unused Rides within a term expire at the end of that term and are not carried over, unless otherwise agreed in writing.
5.3 If a Participant starts their Subscription during a term that is already underway, the Participant receives a pro-rated number of Rides for the remaining part of that term. The Participant also pays the monthly subscription costs pro rata. For a four (4) credit Subscription, the Participant receives one (1) Credit per remaining week. For an eight (8) credit Subscription, the Participant receives two (2) Credits per remaining week. For a twelve (12) credit Subscription, the Participant receives three (3) Credits per remaining week. With an Unlimited Subscription, the Participant has unlimited access for the remaining weeks of that month.
5.4 In the event of prolonged illness, injury, pregnancy or an extended stay abroad, a Subscription may be suspended at the request of the Participant for the duration of the impediment, with a minimum of two (2) weeks and a maximum of six (6) months. Suspension takes place in consultation and upon presentation of written evidence (such as a medical statement). Instead of suspension, the Participant may also choose to terminate the Subscription early in these cases, subject to a notice period of one (1) month, if it is reasonably established (likewise upon presentation of written evidence) that they will no longer be able to take part in Rides during the remaining term of the Subscription.
5.5 Holidays or work pressure do not constitute grounds for suspending the Subscription. Instead, the Participant may make use of the temporary transfer option in article 5.8.
5.6 The Participant may also terminate the Subscription in writing before its term ends if they demonstrably move to a home address that increases the travel time to the Studio to such an extent that they can no longer reasonably be expected to take part in Rides. Cadence determines when this is the case. Termination is subject to a notice period of one (1) month. If the Participant does not receive confirmation, they must contact Cadence directly; otherwise it will be assumed that the cancellation did not reach Cadence.
5.7 Credits have a validity period that is stated per bundle type on the Website and in the Participant's account. After the term has expired, unused Credits lapse without any right to a refund.
5.8 In the event of a holiday or temporary impediment, the Participant may transfer Credits or a Subscription temporarily to a natural person once per calendar year, provided Cadence has been notified in advance by email, stating the name of the substitute and the relevant period. The Participant must have communicated this in writing to Cadence at the latest fourteen (14) days in advance. If the Participant does not receive confirmation, they must contact Cadence directly; otherwise it will be assumed that the cancellation did not reach Cadence.
Article 6 - price and price changes
6.1 The current prices of Credits, bundles, Subscriptions and Gift Vouchers are available on the Website. All prices are in euros and include VAT.
6.2 Cadence reserves the right to change prices. Price changes do not affect Credits already purchased. For Subscriptions, a price change will be announced at least one (1) month in advance. If Cadence increases the price of a Subscription, the Participant has the right to cancel the Subscription within four (4) weeks after the announcement of the price change. The cancellation takes effect on the date on which the new price applies.
Article 7 - payment
7.1 Payment is made in advance via the online payment system on the Website, by direct debit for Subscriptions, or on the spot at the Bar by card or contactless payment. Credits and bundles are paid in full, unless otherwise agreed in writing. Cadence does not accept cash.
7.2 Amounts already paid will not be refunded, except in the case of a legally valid withdrawal in accordance with article 7.3 or a written agreed exception.
7.3 The Participant has the right to withdraw from an online purchase free of charge within fourteen (14) days after purchase, provided no Rides have been used during that period. The right of withdrawal lapses as soon as the Participant has attended a first Ride.
7.4 In the event of late payment, Cadence will send the Participant a written payment reminder, offering an additional payment term of fourteen (14) days to still make payment. If the Participant fails to pay within this term, they will be in default from that moment on and Cadence is entitled to charge statutory interest and extrajudicial costs in accordance with artikel 6:96 lid 2 onder c en lid 5 BW. Cadence is also entitled to temporarily block access to Rides until the outstanding amount has been paid in full.
7.5 If Cadence ceases its business activities, it will inform the Participant of this with due observance of a term of one (1) month. Unused Credits and the remaining part of a prepaid Subscription will be refunded in that case.
Article 8 - introductory offers
8.1 Cadence may periodically offer introductory offers to new Participants, such as a first-Ride package or an introductory discount. The content, validity and price of an introductory offer will be stated on the Website at the time it is offered.
8.2 An introductory offer is only valid for natural persons who have not previously purchased a Credit, Subscription or Gift Voucher from Cadence.
8.3 Introductory offers cannot be combined with other discounts or promotions, unless expressly stated otherwise.
8.4 Introductory offers, first-Ride packages and introductory discounts may be used once per person, unless expressly stated otherwise. Cadence is entitled to investigate misuse and to reverse the offer if it establishes this.
Article 9 - Termination of Subscriptions
9.1 After the minimum term has ended, the Participant may cancel a Subscription in writing or by email, subject to a notice period of one (1) month, in accordance with the Wet van Dam.
9.2 Cadence confirms the cancellation within fourteen (14) days by email. If the Participant does not receive confirmation, they must contact Cadence directly; otherwise it will be assumed that the cancellation did not reach Cadence.
9.3 Cadence is entitled to terminate a Subscription with immediate effect, without any right to a refund, if:
• the Participant, in Cadence's reasonable opinion, repeatedly or seriously acts in breach of the house rules (article 3);
• the Participant obtained a Subscription or Credit under false pretences;
• the Participant makes their account available to third parties outside what is provided for in article 5.8;
• the Participant causes damage to Cadence, its employees or other Participants, or otherwise behaves improperly.
9.4 Upon termination in accordance with this article, Cadence may deny the Participant access to the Studio for a definite or indefinite period.
Article 10 - Obligations of the operator
10.1 Cadence guarantees that the Studio and the facilities offered comply with the Participant Agreement and are maintained in the manner applicable to them.
10.2 Cadence ensures that instructors have the knowledge and skills that may reasonably be expected of them. 10.3 Cadence ensures sufficient first-aid supplies in the Studio.
10.4 Cadence takes reasonable measures to prevent damage to or loss of Participants' property, without prejudice to article 12.4.
Article 11 - Health and fitness to participate
11.1 Indoor cycling is a physically demanding activity. Upon registration, the Participant declares that they are healthy and able to take part in a Ride.
11.2 The Participant is required to inform Cadence or the relevant instructor, confidentially and clearly, prior to a Ride, of any medical conditions that may affect their participation in the Rides. These include, among others (but not limited to): cardiovascular disease, high blood pressure, asthma, epilepsy, knee or back complaints, injuries, pregnancy and use of medication that may affect exercise tolerance.
11.3 In case of doubt, Cadence strongly advises consulting a doctor prior to participation. Cadence may refuse participation or request further information if it reasonably considers this necessary on the basis of health risks.
11.4 The Participant must stop participating immediately and warn the instructor in the event of dizziness, chest pain, shortness of breath, nausea or other symptoms that deviate from normal exertion.
11.5 Cadence is not a medical institution and its instructors are not doctors or physiotherapists. Statements made by instructors about training, recovery or technique do not constitute medical advice.
Article 12 - Risk and liability
12.1 Participation in a Ride and use of the facilities in the Studio are entirely at the Participant's own risk.
12.2 Cadence is not liable for material and/or immaterial damage suffered by the Participant and/or third parties. Cadence is only liable for direct damage that is the direct result of intent or deliberate recklessness on the part of Cadence or its employees.
12.3 Cadence accepts no liability for loss, theft or damage to personal property of the Participant, including while using the changing rooms or the lockers provided.
12.4 The Participant is liable for damage they cause to property of Cadence or of other Participants.
12.5 The exclusions and limitations of liability included in this article also apply for the benefit of Cadence's employees and of all other persons whom Cadence engages in the performance of the agreement.
Article 13 - Bar and catering
13.1 Cadence operates a Bar within the Studio where non-alcoholic drinks, shakes, coffee and light snacks are offered. The Bar operates on a card-payment basis; cash is not accepted. Refreshments must be paid for immediately.
13.2 Allergen information is available on request at the Bar. The Participant is responsible for reporting allergies or dietary requirements prior to ordering.
13.3 Cadence ensures hygienic preparation of refreshments in accordance with applicable food safety regulations. Cadence is not liable for damage arising from consumption (in accordance with article 12).
Article 14 - Personal data and privacy
14.1 Cadence processes Personal Data in accordance with the General Data Protection Regulation (GDPR) and its Privacy Policy, as published on the Website.
14.2 By entering into a Participant Agreement, the Participant declares that they have read the Privacy Policy and agree to the processing of their Personal Data as described therein.
14.3 The Participant is at all times entitled to access, correction, restriction or deletion of their data, as well as to data portability and objection to processing. A request can be submitted via info@cadencecycleclub.com.
Article 15 - Photo and video material
15.1 Cadence is entitled to make photo and video material in the Studio and during Rides for promotional purposes, including publication on the Website, in newsletters, in printed materials and via social media.
15.2 If a Participant objects to being recognisably shown in images, they must report this to the instructor or reception prior to the Ride. In that case, Cadence will, after consultation with the Participant, make an effort to keep the Participant out of view or to make the material unrecognisable afterwards.
15.3 Participants may take photos or video before and after a Ride in the lobby. Making recordings in the spinbox during a Ride is only permitted with the prior consent of the instructor.
15.4 When publishing self-made image material on social media, the Participant must treat other Participants with respect and may not post recognisable persons without their consent.
15.5 Use of the Cadence name, the Cadence logo or other brand features for commercial purposes by third parties is only permitted with Cadence's prior written consent.

16.2 The complaint must be clearly described and, if possible, accompanied by supporting evidence.
16.3 Cadence will respond in writing within fourteen (14) days of receipt of the complaint. If a longer handling period is required, the Participant will be informed of this within that period.
16.4 If the complaint cannot be resolved by mutual agreement, the dispute may be submitted to the competent court in accordance with article 18.

17.1 Cadence strives to keep the information on its Website complete, accurate and up to date, but cannot guarantee this. No rights can be derived from the content of the Website.
17.2 All intellectual property rights to the Website, the Cadence name, the logo, the house style, photography, videos, music selections (insofar as produced or compiled by Cadence) and other materials, rest with Cadence or its licensors.
17.3 Nothing from the Website may be reproduced, made public or stored in an automated data file without Cadence's prior written consent.

18.3 If a provision in these terms and conditions proves to be null and void or voidable, the remaining provisions will remain fully in force. Cadence and the Participant will in that case consult to replace the provision in question with a valid provision that corresponds as closely as possible to the purpose and intent of the original provision.
18.4 These general terms and conditions are effective from 01-10-2026
